These Terms of Service (“Terms”) are a binding agreement between you (“you,” “your,” or “Customer”) and Mnemo LLC (“Mnemo,” “we,” “us,” or “our”). By accessing or using the Mnemo website, APIs, or any related services (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
The Service is currently offered as a beta release. You understand and agree that:
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any defects will be corrected.
To the maximum extent permitted by law, Mnemo and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, Mnemo’s total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid to Mnemo for the Service in the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Because the Service is offered in beta and may be provided free of charge, you acknowledge these limitations are a fundamental basis of the bargain.
You represent and warrant that your access to and use of the Service complies with all applicable local, state, federal, and international laws, rules, and regulations, including those governing data protection, privacy, intellectual property, and export controls. You are solely responsible for ensuring that your use of the Service is lawful in your jurisdiction.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Our collection and use of personal information is described in our Privacy Policy.
We may modify the Service or these Terms at any time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
We may suspend or terminate your access to the Service at any time, with or without cause or notice, particularly during the beta period. Upon termination, your right to use the Service ceases immediately. Sections 2, 3, 8, and 9 survive termination.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
